Bridget Moss represents the interests of owners, developers, contractors and subcontractors in sophisticated title insurance, real estate and construction disputes, including quiet title actions, easements, construction lien claims, landslide/subsidence matters and boundary disputes.  She has successfully litigated complex construction defect claims involving common interest developments, condominiums, mixed use projects and resort facilities.  Ms. Moss also has substantial experience in the design and implementation of development risk strategies, the drafting and negotiation of construction and design agreements, and the analysis and negotiation of multi-million dollar construction insurance programs.

Ms. Moss participates in a number of charitable organizations, especially those benefitting children both at home and abroad.  In particular, Ms. Moss is an active suporter of Best Buddies, Save The Children, Heffer International, and The National Counsel of Jewish Women.  In May 2010, Ms. Moss was recognized by the Public Law Center of Orange County for legal work benefitting low income residents.

ACCOMPLISHMENTS

  • Successful defense of a national title insurance company in a lawsuit alleging escrow fraud.
  • Successful defense of multiple lenders and owners of wrongful or excessive mechanic's lien claims.
  • Representation of national homebuilder in defense of allegations of failure to disclose and fraud arising from sale of residential property.
  • Successful defense of homeowners association in claim to impose an easement by necessity on its common area property.
  • Representation of national homebuilder in defense of several lawsuits, including a class action, arising from allegations of negligent construction of hillside slopes.
  • Drafting and negotiating sophisticated construction agreements for numerous developers and contractors, including design/build agreements.
  • Coverage analysis and negotiation on behalf of developers and contractors of complex construction insurance programs including OCIP, builder's risk, in-transit, off-premises, premises liability, errors and omissions, and excess risk coverages.
