David joined Anderson, McPharlin & Conners LLP as Senior Counsel in 2013 bringing over thirty years of litigation and fifteen years of general counsel experience to the Firm.

David is an accomplished trial lawyer having extensive experience litigating multiple areas of law including jury trial, court trial and appellate matters. David has defended clients in cases spanning from specialty casualty and professional liability defense, to defending marinas throughout California regarding multiple marina operations and liability issues, to defending the Firm’s credit union clients in multiple class actions, to representing and defending development and construction clients in all forms of development, construction and construction defect related cases. David’s practice has also included many years of representing and defending public agencies and their employees in matters spanning from dangerous condition tort claims to Civil Rights police cases and from Public Contract Code matters to inverse condemnation. Moreover, David’s broad base of experience includes many years of handling real property and environmental issues including zoning and land use litigation, California Coastal Act and CEQA litigation, and water law matters both in the courts throughout California and in an extensive administrative agency practice before the California Coastal Commission, California State Lands Commission, California Regional Water Quality Control Boards and the California State Water Resources Control Board.

Additionally, David had the honor to serve three California coastal cities as their City Attorney over the span of fifteen years, the City of Newport Beach, a coastal California charter city of 89,000 residents, and as the City Attorney of the Cities of Morro Bay and Pismo Beach, both general law California coastal cities with residential populations between 8,000 and 10,000. In this capacity David developed an expertise in advising and representing clients with Tidelands Trust, water quality, and harbor and ground lease legal issues. David and his former law firm also served as general counsel to multiple special districts.

David’s representative experience includes the following:

  • Defeating negligence allegations against a Lake Tahoe marina related to the drowning death of one of its customers by convincing the trial court on summary judgment that the decedent had expressly assumed the risk of his activity, that the heirs’ claims were barred by the doctrine of primary assumption of the risk and that the defendant marina was not negligent as a matter of law.
  • Successfully obtaining a writ of mandate from the Superior Court finding the City of Irvine violated the California Environmental Quality Act (“CEQA”) in its efforts to programmatically change the nature of the Irvine Business District to residential multiuse without conducting adequate environmental review and thus commanding the City to conduct adequate environmental review and pay an award of $678,000 in attorneys’ fees and costs to David’s successful client.
  • Defeating on summary judgment a class action lawsuit alleging violations of privacy through an alleged breach of a credit union client’s credit union service organization’s (“CUSO”) computer system by establishing that the representative plaintiff did not have standing and that there was no triable issue of fact as to actual harm.
  • Successfully defending a credit union client of the Firm’s by defeating a class action representative plaintiff’s attempt to certify a class alleging forced purchase of credit life and disability insurance on the credit union’s members without their consent.
  • Defeating at jury trial plaintiff purchasers’ fraud and misrepresentation allegations against the seller of real property asserting that the seller fraudulently failed to disclose the state of the water table below the home that was sold to the plaintiff purchasers.
  • Defending a client city against claims of violations of the Public Contract Code, Clean Water Act, and California Coastal Act in the emergency construction of a desalination plant during the California drought and obtaining and protecting the city’s permits before the Regional Water Quality Control Board and the California Coastal Commission for the construction and operation of the desalination plant.
  • More than a dozen appellate matters before the California Courts of Appeal and United States Ninth Circuit Court of Appeal ranging from obtaining a discretionary writ of mandate protecting peace officer personnel records to affirmation of grants of summary judgments in personal injury cases, to affirming bankruptcy court determinations that a long term tidelands trust ground lease was abandoned by lessees during their bankruptcy proceeding, and including one case before the Supreme Court of the United States dealing with complicated issues of subject matter jurisdiction in the federal courts.
