November 20, 2023 Court of Appeal Affirms Trial Victory for Carleton Burch
GOLTHA GREEN Plaintiff and Appellant v JPMORGAN CHASE BANK NA et al
The Court of Appeal has affirmed the victory at trial by Carleton Burch and Jesse Hernandez (retired) in Goltha Green v. JPMorgan Chase Bank NA, etc. et al Superior Court, Los Angeles County Case Number BC 548724. AMC successfully defended a “downstream” purchaser of two apartment complexes from attacks on its title by a prior owner who had lost the properties to foreclosure. The prior owner alleged that he had not been in default, and that certain alleged irregularities in the foreclosure process rendered the foreclosure, and thus the title of the downstream purchasers, void. AMC attorneys Jesse and Carleton were able to marshal evidence showing that the plaintiff had been in default and did not ever have the funds needed to cure that default, thus rendering the subsequent alleged defects harmless to him. They also pointed out facts that the court relied upon casting doubt on the credibility of the plaintiff’s witnesses.
